Lay out rules for pet owners: Indicate requirements such as requiring spaying/neutering, vaccinations, and immediate waste disposal in common areas. Your lease agreement should also require owners to pay a refundable pet deposit and let you approve each pet individually.
Parties to the lease – the lease agreement should name the landlords and tenants who are bound by the agreement. Description of the property – the lease agreement should have a description of the property controlled by the lease agreement. It may be as simple as the address and apartment number but it must be identified or the agreement cannot be enforced.
Every lease is a contract, and as such will name the people who have entered into the contract and are legally bound by it. That should be your landlord, yourself, and any roommates you might have. Anyone whose name doesn`t appear on the document isn`t legally liable for rent; if you take on a new roommate after the lease has been signed, you may want to ask the landlord to issue a new one. If not, you`re the one who`s liable when they don`t pay their share of the rent.
Terms of rent – the dollar amount should be in the agreement as well as the day of the month rent is due, where the rent is to be sent, and how it will be accepted (by check, by automatic draft, etc.). The terms for late rent should also be in this portion of the agreement.
Security deposit details – the amount of the security deposit, how it is to be paid, and the terms of its future release should be specified in the lease agreement. Occupants of the property – the lease agreement should list the names of every person who will regularly occupy the property and what happens if a person stays for more than a certain length of time.
Impose limits on occupancy: Be clear that the unit`s only legal residents are those adults whose names are on the lease agreement, plus any minor children. This gives you the right to evict any additional residents that you didn`t approve. Include a subletting clause that requires the tenant to obtain your written permission for someone else take over their lease agreement. (You can also forbid subletting altogether.)
